Enforcement Guidance on Retaliation and Related Issues, published in 1998 by the Equal Employment Opportunity Commission, have been revised and replaced with a newer version. In addition to the topics included in the 1998 version, this newer guide addresses retaliation and interference in regards to the Americans with Disabilities Act.
It is critical for organizations to understand what constitutes retaliation as it has been the most frequently alleged basis for claims since 2008. Also retaliation findings made up between 42% and 53% of all finding of EEO violations from 2009 to 2015 (Read more here.)
